By booking your free session you confirm that you are agreeing to the terms below…

The photographer is providing the client with a complimentary photo session and one small print. The client will have the opportunity to make a purchase after the session but there is no obligation.

The Photographer will be in touch to arrange the online 24 hour viewing and ordering session of the photographs within 4 weeks after the session date. The client will have this 24 hour window to choose their free print and to purchase a package or join the monthly print club subscription.

Any printed products ordered, such as albums and wall art will be delivered within 12 weeks after the date that they are ordered and of the design being approved. However the print club will start and the first print will be posted upto 4 weeks after the start date.

Booking fee: The client agrees to pay a booking fee to secure the booking. This fee is refundable at the time of the 24 hour viewing and ordering appointment. Or it can be put towards a purchase.

The Clients and the Photographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this agreement. The Clients also agree to give the Photographer sufficient warning of any change of plans due to sickness ect.

Please note that not all people like having their photo taken. In such cases the Photographer will use their discretion but cannot be held responsible for a lack of photographs of these people. If the Photographer is exposed to (i) unsafe conditions, or (ii) objectionable or illegal acts at the session, the Photographer reserves the right to take reasonable action to remedy such a situation, including but not limited to leaving the situation. In such event, the Photographer shall not be obligated to refund any of the fees paid by Client because of such action.

Copyright: The copyright of photographs remains with the Photographer. The images taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from the Photographer.

Model Release: The Clients grant the Photographer the irrevocable and unlimited consent to use the photographs of the Clients for editorial, competition, blog entries, advertising, social media and any other purpose.

Limit of Liability: If the photographer is too ill or becomes injured and cannot supply the services specified above. The Photographer will try to book a later date with the client. If for some reason it is impossible to have the session at a later date, the client will be limited to a full refund. The photographer has working methods in place to prevent loss or damage to the clients images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons beyond the photographers control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.

Booking Fee/Cancellation: In the event of the Clients cancelling the session, payment of the booking fee will be non refundable and considered as liquidated damages to the photographer, for reserving the date and now not being able to work another job that day.

Protection of Deliverables/Retention of Files. The photographer shall take all reasonable steps to protect the images that are recorded at the Event until such time as the photographs and any products ordered are delivered to Client. Once they have been delivered, the Photographer shall have no further obligation to preserve the images of the session, regardless of the form of media in which they are stored.
